AP High Court Warns Veterinary University Officials in Contempt Case Over Promotion Order

A significant legal development has unfolded in Andhra Pradesh’s higher education sector after the High Court at Amaravati issued strong directions to senior officials of Sri Venkateswara Veterinary University (SVVU) in connection with a faculty promotion dispute.

The court warned that failure to comply with its earlier judgment could lead to personal appearance of university authorities in contempt proceedings.

Contempt Case No.1783 of 2025

The warning came during the hearing of Contempt Case No.1783 of 2025, filed by Assistant Professor Dr. Iqbal Hyder. The petitioner alleged that the university had failed to implement a High Court order delivered in 2023 concerning recognition of past academic service for promotion under the UGC Career Advancement Scheme (CAS).

The case has drawn wider attention to compliance with University Grants Commission (UGC) regulations and institutional accountability in faculty promotions.

Background of the Dispute

Dr. Iqbal Hyder, currently serving at NTR College of Veterinary Science in Gannavaram, approached the High Court in 2021 claiming that SVVU ignored UGC regulations while granting promotions to other faculty members.

He argued that his earlier academic service prior to regular appointment should be counted under the UGC Career Advancement Scheme. According to court records, he:

  • Completed his postgraduate degree in veterinary science in 2012
  • Qualified the National Eligibility Test (NET) in 2012
  • Worked as Research Associate and Teaching Assistant before regular appointment
  • Was appointed as Assistant Professor through formal selection in July 2013

The petitioner maintained that these services met the criteria for recognition under UGC guidelines.

High Court Judgment in 2023

In Writ Petition No.14878 of 2021, the High Court delivered its judgment on July 13, 2023. The court held that UGC regulations provide for counting past academic service under specified conditions.

The court directed the university to reassess the petitioner’s eligibility for promotion, considering his earlier service, and grant consequential benefits including financial arrears if found eligible. The exercise was to be completed within two months.

Alleged Non-Implementation

The petitioner later alleged that despite the clear directions, the university rejected his claim again in December 2024, relying on internal regulations rather than UGC norms. He contended that this amounted to deliberate non-compliance of the High Court’s order.

Subsequently, he filed a contempt petition seeking action under the Contempt of Courts Act, 1971.

Latest Court Direction

During the recent hearing, Justice Venkateswarlu Nimmagadda directed the university authorities to implement the earlier judgment by March 23, 2026.

The court made it clear that if the order is not complied with by that date, the concerned officials must personally appear before the court and explain the reasons for non-compliance.

Broader Legal Implications

Legal observers note that UGC regulations are binding on universities and cannot be overridden by institutional rules. Courts have consistently emphasized adherence to statutory frameworks in matters of recruitment and promotion.
